Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.

A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. SWEEPSTAKES BEGINS AT 12:00:00 AM EST on March 24, 2010 AND ENDS MAY 30, 2010 at 11:59:00 PM EST ("Sweepstakes Entry Period").

ELIGIBILITY: This Sweepstakes is open only to legal residents of the United States and the District of Columbia (excluding Puerto Rico), who are 18 years or older or the age of majority in their state of residence, whichever is older) at the time of entry. Employees of Fresh Express Incorporated, MKTG, and their respective parents, affiliates, subsidiaries, advertising and promotional agencies and any other individuals engaged in any way in the development, production, distribution or execution of this promotion, and their immediate family members (spouse and children, siblings, parents and their spouses and in-laws) or persons living in the households of such employees or individuals are ineligible to enter or win. Void in Puerto Rico and where prohibited or restricted by law. This Sweepstakes is subject to all applicable state and local laws.

HOW TO ENTER: To enter, go to http://www.freshexpress.com/saladforayear during the Sweepstakes Entry period and sign up to receive Fresh Express “Fresh Updates” a weekly email offering great recipes ideas, coupons and tips from Fresh Express and complete the online Entry Form in its entirety. All online entries must be submitted by 11:59:00 PM EST on May 30, 2010 to be eligible. You may also enter, by mailing a postcard with your complete name, address, age and daytime phone number to: Your Salad Story Sweepstakes, 9745 Mangham Drive; Cincinnati, OH 45215, mail in entries must be postmarked by 5/30/10 to be eligible. Each mail-in entry must be submitted in a separate envelope. Limit of six (6) entries per person, regardless of method of entry, including bonus entries for refer a friend. By submitting, you accept the terms and conditions within these complete Official Rules and your entry will become the exclusive property of Sponsor and will not be acknowledged or returned. Entry into the Sweepstakes constitutes permission to use each entrant’s name and image in publicity, if selected as a winner. Once your Entry has been submitted, you will be officially entered into the Sweepstakes. Entry cannot be revised or altered once submitted. A valid e-mail address and Internet access are required to enter the Sweepstakes, via online. Use of automated, programmed, robotic or like forms of entry is prohibited. Upon selection, Winners will be provided a publicity release that must be signed and returned within 5 days of the date of notification. Sponsor is not responsible for typographical errors or any other errors submitted by entrants. Sponsor will not be responsible for lost, garbled, illegible, scrambled, jumbled, destroyed, delayed or misdirected Entry, or for unauthorized access to or alterations of Entry or for errors, omissions, deletions, defects, theft, destruction, interruptions, failures in transmission of Entry, malfunctions of electronic equipment, computer hardware or software, delays in operation, problems registering with the Site, submitting Entry or for other technical problems related to the Internet. Without limiting anything set out elsewhere in these Official Rules, in the case of any dispute, entries will be deemed submitted by the Authorized Account Holder (as defined below) of the e-mail address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Any entrant may be requested to provide Sponsor with proof that he/she is the Authorized Account Holder of the e-mail address associated with his/her entry. Mechanically reproduced entries or entries otherwise generated by a script, macro or other automated means are not eligible and will be disqualified. An entry must be made by the Authorized Account Holder of the e-mail address submitted on the Sweepstakes registration form.

Refer a Friend: After you have registered, you will have the option to refer up to (5) five friends of eligible age by providing name and eligible email address. Each friend will receive an email on your behalf from Sponsor with information regarding this sweepstakes. By participating in the “refer a friend” option and referring 1 to 5 friends, you will receive one (1) additional entry into the random drawing for each valid email provided via the refer a friend component. Limit of five (5) additional entries regardless of method of entry, for a maximum total of six (6) entries over-all (including participant entry).

SELECTION OF WINNERS: Prize winners will be selected in a random drawing on or about June 21, 2010 from among all eligible entries received. Random drawing to be conducted by MKTG, whose decisions are final and binding in all matters relating to this promotion. Odds of winning depend on number of eligible entries received. Winner will be notified by email and given five (5) days to respond with a mailing address. Prizes will be awarded via first class mail. Entry and acceptance of prize constitutes permission to use winner’s name and address city, state, likeness or photograph for advertising and promotional purposes without any additional compensation except where prohibited by law. Winner’s response with the mailing address must also include a signed liability and publicity release. If any notification of prize is not responded to within five (5) days or does not include a signed liability and publicity release, or if prize notification is returned to the sponsor or MKTG as undeliverable, then the prize is void and will be awarded to an alternate winner. Alternate winner will be randomly selected from remaining non-winning entries. Alternate winners will be notified by email and given five (5) days to respond with a mailing address and the signed liability and publicity release. Any and all federal, state and local taxes are the sole responsibility of the winner. Limit of (1) one prize per person. Prize is not transferable. No substitution of prize permitted except that sponsor reserves the right to substitute a prize of equal or greater value.

Winners are solely responsible for all applicable taxes, title, fees and charges on prizes as may be necessary (including, but not limited to, income and sales tax).

Sponsor reserves the right to cancel or suspend the promotion for any reason. Notice of such action will be posted at http://www.freshexpress.com/saladforayear.

PRIZE: (30) Grand Prizes: of (52) Fresh Express salad coupons redeemable for a total of 52 bags of salad. Approximate Retail Value of each prize: $200. Total approximate value of all available prizes is: $6,000.

GENERAL RULES: Each entrant must comply with all terms. By accepting any prize, the winner agrees to release Fresh Express Incorporated and MKTG, their subsidiaries, affiliates, advertising and promotion agencies and their respective employees, officers, directors and agents from and against any and all claims, liabilities, actions or proceedings arising out of injuries including death and / or damages in connection with the acceptance, possession or use of any prize and acknowledge that the parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to, it’s quality, mechanical condition or fitness for a particular purpose. Failure to comply with these Official Rules will result in disqualification. Prize will be shipped to the address an entrant submits at time of registration. Without limiting anything set out elsewhere in these Official Rules, Sponsor Entities are not responsible or liable for: (i) errors in the administration or fulfillment of the Sweepstakes, including, without limitation, mechanical, human, printing, distribution or production errors; (ii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties of any kind; (iii) any condition caused by events beyond the control of the Sponsor which may cause the Sweepstakes to be disrupted or corrupted; (iv) any losses, damages, or any injuries caused directly or indirectly by the acceptance or use of the prize or from participation in the Sweepstakes; or (v) any printing or typographical errors in any materials associated with the Sweepstakes. Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Sponsor’s servers or elsewhere, will not be eligible. Sponsor may disqualify an entrant(s) at its sole discretion if such entrant(s) show a disregard for the Sweepstakes or Official Rules, or if such entrant(s) act(s): (a) in a manner Sponsor determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or the Sponsor; (c) in any other disruptive manner; or (d) in violation of the Privacy Policy and Terms & Conditions of the Site. Notwithstanding anything to the contrary contained in these Official Rules, Sponsor further reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes if it is not capable of completion as planned, including by reason of electronic viruses, other malicious software attacks, unauthorized intervention, systems malfunctions, bugs, tampering, failures, difficulties, force majeure or other causes of any sort; in such event, if Sponsor, in its sole discretion, determines to continue with the Sweepstakes, the winner will be selected in a random drawing from among all eligible entries received for such affected drawing(s) prior to and/or after (as appropriate) the action taken by Sponsor, in which event, notice will be posted at http://www.freshexpress.com/saladforayear.
